1. Terms and Conditions of Use and Purchase: These terms and conditions are presented to you by Smartvisit Solutions Australia (SVS) (ABN 46 096 253 093) of Smartvisit Solutions Australia Suite 303, Level 3 272 Pacific Highway Crows Nest NSW 2065 Australia. These Terms and Conditions of Use and Purchase shall apply to the use of the www.sydneyfiveinone.com internet service and the purchase of a Sydney Five in One Pass (Package).

2. www.sydneyfiveinone.com is an Internet based service owned and operated by SVS. By using sydneyfiveinone.com.au or any SVS affiliated website you agree to be legally bound by these terms, which shall take effect immediately. Please review these Terms & Conditions regularly to ensure you are aware of any changes made by SVS. Your continued use of sydneyfiveinone.com.au, a SVS-affiliated website or the Package after changes are posted means you agree to be legally bound by these terms as updated and/or amended. If you do not agree to be legally bound by all the following Terms & Conditions, please do not access and/or use sydneyfiveinone.com.au or a SVS-affiliated website.

3. You must read these terms and conditions carefully prior to purchasing a Package and accepting possession of the iVenture Experiences Card (Card). The Card will provide you access to the benefits (Benefits) included in the Package purchased as detailed in this website or in the print material provided with the Card (Guide). Upon your purchase of the Package or accepting possession of the Card you agree to be bound by these terms and conditions. You agree that the use of the Card and nothing in these terms and conditions constitutes a relationship of partnership, agency, trust or fiduciaries between us and you.

4. The Package gives you the opportunity to receive certain benefits when you shop or visit certain venues and attractions (Merchants), as detailed in the Guide, and present a valid Card. The Package is non-refundable. The decision to take advantage of these opportunities is strictly at your discretion and any unused benefits at the time of expiry of the Card will not be refundable or transferable to another Card. No replacements or refunds are offered for lost or stolen Cards and the Card is not valid for any same day return visits to any attraction or venue. The Card provided with the Package will expire 12 months from the date of purchase. A separate Card will be supplied to you for each Package purchased.

5. The Guide provides information relating to the Benefits included in the Package as provided by Merchants. We have taken our best endeavours to ensure that the Benefits detailed in the Guide are current at the date of publication. However, such benefits may be changed from time to time at the discretion of Merchants. Before relying on any information provided, such as the Merchants agreement to provide the Benefit or their opening hours, you should confirm their authenticity by contacting the Merchant directly.

6. The Benefits included in the Package are only accessible through use of the Card which must be presented to the Merchant to enable the deduction of credit (Credit) which has been loaded onto the Card. To obtain the Benefit, you must have sufficient Credit on the Card which will be redeemed by the Merchant. Credit loaded onto a Card upon the purchase of a Package may only be redeemed a maximum of once per Merchant. You may not return to a Merchant to redeem additional Credit to whom you have already received a Benefit in respect to the Package purchased. We take no responsibility for the conduct, quality, availability, health and safety provisions or any other thing related to the benefits available from the use of the Card with such responsibility being borne exclusively by the Merchants.

7. We have taken all reasonable care in compiling the material on this website and arranging the benefits offered by the Package and Card. However, you use this website and the Card is at your own risk. To the extent permitted by law, we make no warranties about the accuracy or completeness of any material in this website or that the Card or the benefits offered by the Package will attain any particular service standards, be free of defects or be fit for any particular use. We limit our liability for warranties implied by statue or otherwise resupplying the relevant services. To the extent permitted by law, we disclaim all liability arising out of or consequent to your use of the Card. You indemnify us against any loss or damage suffered by us or any third party as a result of your use of the Card or the Guide or breach of any of these terms and conditions.

8. All intellectual property rights used or embodied in or in connection with the Package, Card, Website or any related material is owned or licensed to us. You must not use, reproduce, distribute, modify, adapt or in any other way interfere with such intellectual property rights.

9. All rights in the material contained within this website it licensed to us. We assume no responsibility for the content of any other website to which this site has links, nor to the content pertaining to our products contained on other websites.

10. The trademarks appearing on this website are primarily trademarks of SVS. Other trademarks displayed are trademarks of their respective owners. Nothing contained on this website should be construed as granting any right of use of any trademark displayed on the website without the express written permission of SVS or the third party owner.

11. By purchasing online, you accept the delivery and collection options made available to you. The decision to take advantage of any of these options is strictly at your discretion. Should you choose to select the delivery option, please ensure you allow at least 5 working days for deliveries within Australia, or 14 working days for worldwide delivery. We cannot replace any items not delivered in time, or lost in transit.

12. GST will apply to all goods and services supplied through this website. Prices displayed on this website exclude GST where applicable.

These terms and conditions of purchase are presented by Smartvisit Solutions Australia ABN 46 096 253 093 (SVS). Upon purchase of this package (Package), a card (Card), designated by a display of the SVS logo, will be electronically loaded with tickets, vouchers, points (collectively Tickets) which may be redeemed to obtain certain benefits (Benefits) when the Card is presented to the attractions, restaurants or other operators (Operators) detailed in this guide (Guide). By purchasing this Package you agree to be bound by these terms and conditions: i) All Tickets included in this Package will expire (3) three months from the date of purchase of the Package; ii) You may not return to an Operator to obtain a Benefit a second or subsequent time; iii) Refunds will not be provided for any unused Benefits or lost or stolen Cards; iv) Benefits presented in this Guide may vary from time to time and as such you should confirm the availability of the Benefit with the Operator prior to use of the Card; v) To the extent permitted by law, SVS disclaims all liability arising out of or consequent to your use of the Card, Guide and Benefits; vi) All responsibility for the conduct, quality, availability or other thing in respect of the use of any Benefit is solely borne by the relevant Operator; vii) SVS limits our liability or warranties implied by statute or otherwise by resupplying the relevant services; and viii) All intellectual property rights used or embodied in or in connection with the Card, Guide or any related material is owned or licensed to SVS.
